ASSUMPTION OF RISK AND RELEASE OF LIABILITY
I recognize that adaptive dance classes and related activities (including, but not limited to, online or virtual classes, in-studio classes, performances, camp, and other activities), including All in Arts, Inc., dance activities, are potentially risky and hazardous because they require physical exertion that may be strenuous and may cause medical concerns (physical and emotional) and physical injury.
In consideration of my being permitted to participate in All in Arts activities, I agree to assume full responsibility for any and all risks, hazards, injuries, damages or losses (known or unknown) of any kind which I sustain as a result of such participation.
I understand that it is my responsibility as a participant (“Dancer”) in All in Arts activities to consult with a physician prior to and regarding my participation in any fitness program. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in All in Arts activities. If I have any physical or emotional condition that may limit my ability to fully participate in some activities of All in Arts, I agree to promptly notify the All in Arts instructor of such limitations and to refrain from participating in such activities.
In further consideration of my being permitted to participate in All in Arts activities, I knowingly, voluntarily and expressly waive any claim or cause of action that I may have against All in Arts, its employees, volunteers, officers, directors and agents, for any injury, damage or loss (known or unknown) of any kind that I may sustain as a result of such participation.
I understand and agree that this Assumption of Risk and Release of Liability (“Release”) is a legally binding assumption of risk, release, waiver, discharge and covenant not to sue All in Arts, Inc., including its employees, volunteers, officers, directors and agents, for any injury, damage, or loss (known or unknown) of any kind that occurs as a result of my participation in all All in Arts activities. I further agree that this Release is made voluntarily by the undersigned Dancer, or parent, guardian or authorized representative on behalf of such Dancer, and is legally binding upon Dancer, his/her heirs, executors, administrators, agents, legal representatives, parents and legal guardians.
If agreement to this Release is made by an authorized representative, parent or legal guardian, such authorized representative, parent or legal guardian certifies that s/he has the legal right to agree to this Release and to assume risks, release, waive, discharge and agree not to sue on behalf of Dancer.
Dancer and, if applicable, his/her authorized representative, parent or legal guardian, certify that they have read this Release and fully understand and agree to its contents and, by doing so, are freely and voluntarily waiving substantial rights, including the right to sue, and freely and voluntarily intend to completely and unconditionally assume all risks related to Dancer’s participation and to release All in Arts, its employees, volunteers, officers, directors and agents, from any and all claims or causes of action for damages related to any injury or loss (known or unknown) of any kind that Dancer may sustain as a result of his/her participation, including, but not limited to, damages caused by the negligence of All in Arts’ employees, volunteers, officers, directors and agents.
This Release shall remain in effect for as long as Dancer participates in any class or other activities of All in Arts.
PHOTO/VIDEO WAIVER
I hereby grant to All in Arts, including its employees, volunteers and agents, the right to photograph and video Dancer in connection with his/her participation in All in Arts activities. I authorize All in Arts, its assigns and transferees, to copyright, use and publish the same in print or electronically. I agree that All in Arts my use such photographs and video of Dancer with or without Dancer’s name and for any lawful purpose, including, but not limited to, publicity, advertising, illustrations and web content.
PARENT / LEGAL GUARDIAN SUPERVISION POLICY
If Dancer needs more assistance that All in Arts is able to provide or support, Dancer’s parent or legal guardian may be required to participate with Dancer.
For in-studio classes, one parent/guardian per Dancer must be on site for the duration of the class.
For online classes, one parent, legal guardian, or adult representative must be nearby to assist and support Dancer as needed. We encourage such supportive participation to help elevate Dancer’s experience.
